Preliminary Determinations Open for Public Comment
The following Final Determinations on Notice of Construction (NOC) applications for approval of construction or modification of an air pollution source have been made and are subject to a 30-day appeal period. Any person, government agency, or group who submitted comment during the public comment period, or the applicant may appeal the Regulatory Order [Order of Approval or Order to Deny Construction] issued in conjunction with a Final Determination. Appeals may be made to the Washington Pollution Control Hearings Board (PCHB) in accordance with Chapter 371-08 of the Washington Administrative Code by filing the appeal with the PCHB and serving a copy to ORCAA within 30 days after receiving the Regulatory Order and notice of Final Determination. This is the exclusive means of appeal. Please consult the PCHB for details on the appeal process.
